Apéndices I, II y III

en vigor a partir del 26 de noviembre de 2019

Interpretación

1.    Las especies que figuran en estos Apéndices se clasifican:

a) con arreglo al nombre de las especies; o

b) como si todas las especies estuviesen incluidas en un taxón superior o en una parte designada del mismo.

2.    La abreviatura “spp.” se utiliza para denotar todas las especies de un taxón superior.

3.    Otras referencias a los taxa superiores de la especie se indican únicamente a título de información o de clasificación. Los nombres comunes que aparecen después de los nombres científicos de las familias se incluyen a título de referencia. Su finalidad es indicar la especie dentro de la familia de que se trate que está incluida en los Apéndices. En la mayoría de los casos no se trata de todas las especies de la familia.

4.    Las abreviaturas siguientes se utilizan para taxa de plantas por debajo del nivel de especie:

a) “ssp.” para denotar las subespecies; y

b) “var(s).” para denotar la variedad (variedades).

5.    Habida cuenta de que ninguna de las especies o taxa superiores de FLORA incluidas en el Apéndice I están anotadas, en el sentido de que sus híbridos sean tratados de conformidad con las disposiciones del Artículo III de la Convención, los híbridos reproducidos artificialmente de una o más de estas especies o taxa pueden comercializarse con un certificado de reproducción artificial, y las semillas, el polen (inclusive las polinias), las flores cortadas, los cultivos de plántulas o de tejidos obtenidos in vitro, en medios sólidos o líquidos, que se transportan en envases estériles de estos híbridos no están sujetos a las disposiciones de la Convención.

6.    Los nombres de los países entre paréntesis colocados junto a los nombres de las especies incluidas en el Apéndice III son los de las Partes que solicitaron la inclusión de estas especies en ese Apéndice.

7.   Cuando una especie se incluya en uno de los Apéndices, se incluye el animal o planta entero, vivo o muerto. Además, para las especies de fauna  incluidas en el Apéndice III y las especies de flora incluidas en los Apéndices II o III, todas las partes y derivados de la especie también están incluidos en el mismo Apéndice, salvo que vaya acompañada de una anotación en la que se indique que sólo se incluyen determinadas partes y derivados. El signo (#) seguido de un número colocado junto al nombre de una especie o de un taxón superior incluido en el Apéndice II o III se refiere a una nota de pie de página en la que se indican las partes o derivados de animales o plantas que se designan como "especímenes" sujetos a las disposiciones de la Convención de conformidad con el subpárrafo ii) o iii) del párrafo b) del Artículo I.

8.   Los terminos y expresiones infra, utilisados en anotaciones en estos Apéndices, se definen como sigue:

Accesorios de instrumentos musicales acabados

Accesorio de un instrumento musical (según lo dispuesto en el capítulo 92 del Sistema Armonizado de la Organización Mundial de Aduanas: Instrumentos musicales; sus partes y accesorios) que está separado del instrumento y que está diseñado o configurado específicamente para ser utilizado explícitamente en asociación con un instrumento y no requiere ninguna otra modificación para ser utilizado.

Astillas de madera

Madera que ha sido reducida a trozos pequeños.

Diez (10) kg por envío

En lo que respecta al término “10 kg por envío”, debe interpretarse que el límite de 10 kg hace referencia al peso de las distintas partes de cada artículo del envío elaborado con la madera de la especie en cuestión. En otras palabras, el límite de 10 kg debe evaluarse teniendo en cuenta el peso de las partes individuales de madera de especies de Dalbergia o Guibourtia que contiene cada artículo del envío y no teniendo en cuenta el peso total del envío.

Envío

Cargamento transportado con arreglo a las condiciones de un único conocimiento de embarque o una única carta de porte aéreo, independientemente de la cantidad o el número de contenedores o paquetes; o piezas llevadas puestas, transportadas o incluidas en el equipaje personal.

Extracto

Toda sustancia obtenida directamente de material vegetal mediante medios físicos o químicos independientemente del proceso de fabricación. Un extracto puede ser sólido (p.ej., ejemplo, cristales, resina, partículas finas o gruesas), semisólido (p.ej., gomas, ceras) o líquido (p.ej., soluciones, tinturas, aceite y aceites esenciales).

       Madera transformada

De acuerdo con la definición del código 44.09 del Sistema Armonizado: Madera (incluidas las tablillas y frisos para parqués, sin ensamblar) perfilada longitudinalmente (con lengüetas, ranuras, rebajes, acanalados, biselados, con juntas en v, moldurados, redondeados o similares) en una o varias caras, cantos o extremos, incluso cepillada, lijada o unida por los extremos.

Partes de instrumentos musicales acabadas

Parte (según lo dispuesto en el capítulo 92 del Sistema Armonizado de la Organización Mundial de Aduanas: Instrumentos musicales; sus partes y accesorios) de un instrumento musical que está lista para su instalación y está diseñada y configurada específicamente para ser utilizada explícitamente en asociación con el instrumento para que este pueda tocarse.

Polvo

Sustancia seca y sólida, en forma de partículas finas o gruesas.

Productos acabados empaquetados y listos para el comercio al por menor

Productos transportados individualmente o a granel que no requieren otro procesamiento, empaquetados, etiquetados para su uso final o para el comercio al por menor en condiciones para ser vendidos al público en general o ser utilizados por él.

Productos musicales acabados

Instrumento musical (según lo dispuesto en el capítulo 92 del Sistema Armonizado de la Organización Mundial de Aduanas: Instrumentos musicales; sus partes y accesorios) que esté listo para tocar o requiera solo la instalación de piezas para estar listo para tocar. Este término incluye los instrumentos antiguos (definidos por los códigos 97.05 y 97.06 del Sistema Armonizado: Objetos de arte o colección y antigüedades).
